Member of the OPPOSITION BLOC Vladislav Finik at the European Court of Human Rights challenges his illegal lustration

The European Court of Human Rights has accepted the complaint of the deputy of the Odessa Regional Council from the OPPOSITION BLOC Vladislav Finik. The complaint was filed for the illegal dismissal of Vladislav Vasilyevich from the prosecutor's office through the lustration procedure.

The applicant demands to recognize that Ukraine has violated articles 5 and 6 of the Convention for the Protection of Human Rights and the Citizen, which provide for the right to a fair trial and the right to privacy.

After a positive decision of the court, Ukraine will be obliged to restore a lustrated official in office, and to pay Vladislav Finika a compensation of several thousand euros.

“The adoption of the claim for consideration is a confirmation of the fact that the human right to obtain a fair trial of the case in Ukraine has been denied. In other cases, it would be necessary to pass all Ukrainian judicial instances and only then apply to the ECHR. But the European Court of Human Rights understands that in recent years, citizens of Ukraine are deprived of the right to a fair trial and therefore accepts claims even in the absence of their permission in Ukraine,”, the deputy of the Odessa Regional Council from the OPPOSITION BLOC Vladislav Finik commented the situation.

At the moment, the number of complaints to the ECHR related to illegal dismissal through lustration is increasing. At the time of December 2016, there were 26 such complaints in the ECHR’s production.
